Order : This petition coming on for orders upon perusing the petition and the affidavit filed in support thereof and upon hearing the arguments of M/S.S.MANURAJ, Advocate for the petitioner and of M/S.P.R.DILIPKUMAR, Standing Counsel on behalf of the Respondents the court made the following order:- This miscellaneous petition has been filed to disburse the subsistence allowance and dearness allowance to the petitioner for the months of November and December 2017. 2.The learned counsel for the respondents has filed two cheques towards the payment of subsistence allowance before this Court today and submits that petitioner has to file a separate petition for the month of January 2018, for the payment of the same. The learned counsel for the petitioner agrees to file such a petition within a period of three days from today.

If such petition is filed, the respondents are directed to pay the subsistence allowance for the month of January within 10 days thereof. So far as the future subsistence allowance is concerned, the petitioner shall make an application for the same by the 2nd of the succeeding English calender month and if the same falls on a public holiday on the next working days such application be made. The respondents shall then pay the same to the petitioner within 10 days thereof. It is made clear that the respondents are at liberty to deposit the amount in the account of the petitioner, where his salary was being credited.

3. The learned counsel for the petitioner shall hand over the cheques to the writ petitioner and obtain his signature in the revenue stamp within a period of seven days and hand over the same to the respondents or their counsel. -sd/- 20/02/2018 / TRUE COPY / Sub Assistant Registrar ( Statistics / C.S. ) High Court, Madras - 600 104.
