Crl.MP.No.12639 of 2023 in Crl.OP.No.26311 of 2019 Crl.MP.No.12639 of 2023 in Crl.OP.No.26311 of 2019 M.S.Ramesh.J., Originally, bail was granted to the petitioner on 03.12.2018, on condition that the petitioner shall deposit a sum of Rs.5 lakhs to the credit of Cr.No.17 of 2018, together with two sureties, out of which, one shall be a Government Servant and another shall be the blood relative. Unable to comply with the condition, modification petition was filed and by an order dated 01.10.2019, the bail conditions were modified to the effect that the petitioner shall execute a bond for a sum of Rs.1,00,000/- with two sureties, out of which, one surety should be the blood relative. The present petition has been filed for further modification.
2. According to the learned counsel for the petitioner, though, the original bail was granted on 03.12.2018, the petitioner is unable to furnish the required surety and is stranded inside the jail for the past almost 5 years.
3. Since this Court has already granted a bail and by taking into account the ineligibility on the part of the petitioner to comply with the condition imposed on him, I am inclined to further modify the conditions. https://www.mhc.tn.gov.in/judis

4. In the result, the present Criminal Miscellaneous Petition is allowed. Consequently, the condition imposed in the order passed in Crl.O.P.No.26311 of 2019 dated 01.10.2019, shall stand modified to the effect that the petitioner shall execute a bond for a sum of Rs.1,00,000/- (Rupees One Lakh Only) for two sureties for a like sum.
