This Criminal Original Petition is filed under Section 482 of the Criminal Procedure Code praying to direct the respondents to re-investigate the Crime No.408 of 2008 on the file of the third respondent.

ORDER

The present petition has been filed to direct the respondents to conduct re-investigation in Crime No.408 of 2008 on the file of the third respondent viz., the Superintendent of Police, CBCID, Chennai.

2. The petitioner is the father of the deceased Indira Gandhi. A final report was filed for the offences punishable https://hcservices.ecourts.gov.in/hcservices/

under Sections 302, 379 of I.P.C and Section 3(2)(V) of SC & ST Act against one Shankar, accused. The petitioner is shown as witness No.5 in S.C.No.324 of 2008. When the Criminal Original Petition was pending, a report was called for by this Court from the learned Principal Sessions Judge, Salem and he also sent a report dated 27.06.2018, contending that the sole accused in S.C.No.324 of 2008 committed suicide on 27.02.2018 and therefore charge against him stood abated.

3. In the facts and circumstances of the present case, nothing survives in this petition for further adjudication and therefore, the same is dismissed. Consequently, connected Miscellaneous Petition is closed.
