ORDER

This Criminal Original petition has been filed for a direction to the respondent to investigate the case registered in Crime No.414 of 2021 pending on the file of the 2nd respondent. 1/3

The learned Additional Public Prosecutor on instructions submitted that the investigation has been completed and a closure report was filed as mistake of fact before the XVIII Metropolitan Magistrate Court, Saidapet, Chennai. The learned Additional Public Prosecutor further submitted that RCS notice is yet to be served on the defacto complainant.

In view of the above development, there shall a direction to the respondent police to serve the RCS notice to the defacto complainant within a period of two weeks from the date of receipt of a copy of this order. If the petitioner is aggrieved by the same, protest petition can be filed before the concerned Court and he can work out his remedy in the manner known to law.

This Criminal Original petition is disposed of in the above terms.
