Munusammy to the Petitioner.

ORDER

This writ petition has been filed challenging the impugned proceedings of the 2nd respondent dated 21.04.2025 and for a consequential direction to the 2nd respondent to issue legal heirship certificate on the demise of the petitioner's father V.Munusamy.

2.Heard Mr.C.Kathirudayan, learned cousnel for the petitioner and Mr.R.Neelakandan, learned Additional Advocate General for R1 & R2. 3.The case of the petitioner is that her father took treatment at Railway Hospital at Perambur and died on 03.12.1975. The petitioner submitted an application for legal heirship certificate and the same has been received by the 2nd respondent on the ground that neither the petitioner nor any other family members are residing at Mambalam and for the last 27 years, no family member has ever resided at Mambalam.

4.In the considered view of this Court, the petitioner can always submit an application to the concerned jurisdictional Tahsildar where the petitioner resides. While dealing with the application, the no objection certificate from the 2nd respondent can be obtained. Once such application is submitted by the petitioner before the jurisdictional Tahsildar, the same shall be acted upon and an enquiry shall be conducted and legal heirship certificate can be issued. This writ petition is disposed of in the above terms. No costs. 26.06.2025 Index : Yes/No NCS : Yes/No KP To 1.The District Collector Collector Office Chennai.
