ORDER
This Writ Petition is filed to direct the 2nd respondent herein to consider the petitioner's representation dated 09.05.2025, for approval of modification of the petitioner's vehicle bearing registration No.TN-02/AL-
4799, in the 1st respondent's portal, in view of the fitment of CNG kit in the petitioner's aforesaid vehicle.
2. The petitioner is the registered owner of the Honda City car, bearing Regn. No.TN-02/AL-4799. The petitioner states that the Central Government with an objective of reducing air pollution, formulated a policy decision permitting the motor vehicles to use LPG or CNG as a fuel. Pursuant thereto, the Central Government permitted the retro-fitting of the CNG kit in the existing vehicles. The petitioner avers that he fitted a CNG kit in his aforesaid vehicle in March, 2025, through an authorized dealer. In furtherance of the same, the petitioner submitted an application on 22.03.2025, under Section 52 of the Motor Vehicle Act, for alteration in form NAMV to the first respondent. The Motor Vehicle Inspector inspected the vehicle and submitted a report dated 24.03.2025, that a CNG kit had been duly fitted in the petitioner's vehicle.
3. The petitioner submits that pursuant to the MVI report, confirming the CNG kit installation, the first respondent was required to upload the LPG/CNG kit number in the Vahan portal. However, vide communication dated 06.05.2025, the 1st respondent directed the petitioner to approach the 2nd
respondent for approval and movement of the modification in the 1st respondent's office portal. It is submitted that only upon such approval and movement of the modification by the 2nd respondent, the 1st respondent's vahan portal would allow the petitioner to remit the requisite fee and complete the process. Under the circumstances, the petitioner on 09.05.2025, submitted a representation to the 2nd respondent, seeking approval for modification of vehicle particulars in their computer system, so as to enable the petitioner to pay the requisite fee for alteration. However, despite the petitioner's representation, the 2nd respondent failed to take any action. Hence, the petitioner approached this court for the above stated relief.
4. Learned counsel for the petitioner submitted that he would restrict the relief to a direction to the 2nd respondent, to consider the petitioner's representation dated 09.05.2025 and pass orders within a time frame fixed by this court.
5. In view of the aforesaid facts and in the light of the limited submission of the learned counsel for the petitioner, this court is inclined to
direct the 2nd respondent, to consider the petitioner's representation dated 09.05.2025 on merits and in accordance with law and to take appropriate action, as necessary, within a period of four weeks, from the date of receipt of a copy of this order.
6. In the result, this Writ Petition is disposed of with the above direction. No costs.
