ORDER

The petitioner apprehends arrest for the alleged offences under Sections 296(b), 115(2), 121(1) and 351(3) of BNS, in Crime No.233 of 2026 on the file of the respondent police seeks anticipatory bail.

2. The case of the prosecution is that the defacto complainant, who is a Village Administrative Officer, allegedly obstructed the public servant in the discharge of his official duties, abused him in filthy language and assaulted him with hands. Hence, the case.

3. The learned counsel for the petitioner submitted that the petitioner is innocent and has been falsely implicated in this case. He further submitted that the petitioner is ready to abide by any conditions that may be imposed by this Court and that he is ready to cooperate with the investigation. Hence, he prayed to grant anticipatory bail to the petitioner.

4. The learned Government Advocate (Criminal Side) appearing for the respondent Police reiterated the prosecution case and submitted that the investigation is pending. Hence, he opposed the grant of anticipatory bail.

5. This is a case of an assault against a government employee which cannot be tolerated. Under these circumstances, if this court enlarge the petitioner on the anticipatory bail, the same would encourage others to behave in similar way. Hence, this Court is not inclined to enlarge him on bail.
