O R D E R

This Criminal Original Petition has been filed seeking a direction to the District Judge-cum-Chief Judicial Magistrate, Udhagamandalam, The Nilgiris to dispose of the appeal in Crl.A.No.143 of 2017.

2. The petitioner is the respondent in Crl.A.No.143 of 2017, which is pending on the file of the District-cum-Chief Judicial Magistrate Court, Ooty, The Nilgiris. The appeal has been filed by the respondent, challenging his conviction and sentence for the offence under Section 138 of the Negotiable Instruments Act, 1881 in STC.No.1987 of 2012. This petition has been filed by the petitioner/complainant for a direction to the Appellate Court to complete the appeal within a time bound manner.

3. Taking into consideration the fact that the complaint is of the year 2012, this Court directs the District-cum-Chief Judicial Magistrate, Ooty, The Nilgiris, to complete the case in Crl.A.No.143 of 2017 within a period of three months from the date of receipt of a copy of this order, provided, there is no other legal impediment. If the appellant/accused adopts any dilatory tactics, the order of suspension of sentence and bail can be cancelled and he can be remanded to custody. https://hcservices.ecourts.gov.in/hcservices/
