ORDER

The petitioner/A7 apprehends arrest for the alleged offence under

Sections 20(b)(ii)(C), 27A, 28, 29 of the Narcotic Drugs and Psychotropic Substances Act, 1988 in NCB F.No.48/1/14/2025-NCB/MDS in connection with C.C.No.372 of 2026, on the file of the respondent police seeks anticipatory bail.

The allegation against the petitioner is that the petitioner along with other accused, were found in illegal possession of 590 kgs of ganja. Hence, the complaint.

3. The learned counsel for the petitioner would submit that the petitioner is innocent and has been falsely implicated in this case. He further submitted that the petitioner was not involved in any of the offences and no recovery was effected from him, and the charge sheet has already been filed. Hence, he prayed for grant of anticipatory bail to the petitioner.

4. The learned Special Public Prosecutor for the respondent strongly opposed the application and submitted that the case involves narcotic substances and that if the petitioner is enlarged on bail, it may embolden him to indulge in similar activities.

5. I have given anxious consideration to the submissions made by the learned counsel on either side and also perused the records available.

6. Taking into consideration the seriousness of the allegations against the petitioner, this Court is of the firm view that the petitioner does not deserve the grant of anticipatory bail. If anticipatory bail is granted, it would jeopardize the prosecution case.
