ORDER

This petition is filed to direct the respondent not to harass the petitioner in respect of the complaint given by Somu Farms owner's Association.

2. When the matter came up for hearing, the learned Government Advocate (Crl.Side) appearing for the respondents submitted that the petitioner was called for enquiry only by the issuance of summons based on a complaint.

3. The learned counsel appearing for the petitioner submitted that there are civil disputes pending between the parties and several proceedings are already ongoing. There is absolutely no justification for the complaint and the petitioner is being unnecessarily harassed.

4. When a complaint is specifically lodged and taken up for enquiry based on a summons, the petitioner can appear once before the respondents and submit all documents on his behalf. On the same day, the respondents shall make a decision with reference to the complaint and thereafter, unless they decide to proceed further by registering a case, the petitioner shall not be otherwise harassed.

5. Let the petitioner appear before the respondent police for enquiry on 2/4

6. With the above direction, the Criminal Original Petition stands disposed of.
