Respondents PRAYER: Writ Petition is filed under Article 226 of Constitution of India praying to issue a Writ of Certiorarified Mandamus calling for the records in perusal to the impugned letter issued by the second respondent in proceedings NAKA No.A1/4285/2016 dated 17.08.2017 and 07.01.2020 and quash the same and consequently direct the respondents to consider the appointment of second petitioner in any suitable post on compassionate ground with all service benefits.

ORDER

This Writ Petition has been filed challenging the order passed by the second respondent dated 17.08.2017 and 07.01.2020, thereby rejected the request made by the petitioner seeking employment on compassionate ground.

2. Heard the learned counsel appearing on either side and perused the materials available on record.

3. The first petitioner's husband, while he was working as Head Constable, died due to accident on 14.07.2016. At the time of his death, the second petitioner was a minor. After attainment of majority, the petitioner has submitted an application seeking appointment on compassionate ground. However, it was rejected on the ground that the application should be made within a period of three years from the date of death of the employee.

4. Admittedly, the first petitioner made an application after a period of three years seeking employment for the second petitioner. That 2/4

apart, the second petitioner was a minor at the time of his father's demise. Therefore, after a period of eight years, the request made by the petitioner cannot be considered. That apart, this writ petition has been filed challenging the rejection order dated 17.08.2017 and 07.01.2020 after a period of several years. Therefore, the writ petition is devoid of merits and it is liable to be dismissed.
