Respondents PRAYER:- Writ Petition is filed under Article 226 of the Constitution of India praying to issue a Writ of Mandamus directing the third respondent herein to survey the petitioner's lands comprised in new survey No.452/1A2, 452/3A, old survey No.480, as per the petitioner's sale deed dated 22.02.1981, registered as document No.397 of 1981 at the Sub Registrar's Office, Vanoor.

ORDER

This writ petition is filed to issue a Writ of Mandamus directing the third respondent herein to survey the petitioner's lands comprised in new survey No.452/1A2, 452/3A, old survey No.480, as per the petitioner's sale deed dated 22.02.1981,

registered as document No.397 of 1981 at the Sub Registrar's Office, Vanoor.

The petitioner owned land admeasuring 2.92 acres comprised in old survey No.444, new survey no.480 situated at Mathur Village, Vanoor Taluk, Villupuram District by the registered sale deed dated 22.02.1981 vide document No.397 of 1981. He is in possession and enjoyment of the subject land by cultivating seasoned crops from the date of his purchase. The subject property is also assessed to all revenue dues and the petitioner is regularly paying the revenue dues. After purchase, the entire revenue records were mutated in his favour. While being so, the adjacent owners also claimed ownership without any valid title over the said property. Therefore, the petitioner requested the third respondent to survey the subject land as per the sale deed dated 22.02.1981. He also paid requisite fees to survey the same on 07.06.2021. Even then, the third respondent did not take any steps to survey the subject land belong to the petitioner.

Therefore, the third respondent is directed to survey the petitioner's land comprised in new survey No.452/1A2, 452/3A, old survey No.480, as per the petitioner's sale deed dated 22.02.1981, registered as document No.397 of 1981 at the Sub Registrar's Office, Vanoor, within a period of six weeks from the date of receipt of copy of this order. It is made clear that the third respondent is directed to issue notice to the adjacent land owners, if any, before surveying the subject land.

4. With the above directions, this writ petition is disposed of. No order as to costs.
