ORDER

The petitioner has filed this Writ Petition praying for issuance of a Writ of Certiorarified Mandamus to call for the records of the respondent in Na.Ka.No.17/2025/Va.Ka.Ni/, dated 01.06.2025 and quash the same and consequently, direct the respondent to grant permission and Police protection to conduct cultural programme (Adal Padal Nigalchi) in the event of Vaduvoor Melpathi Village Durai Aasai Thambi Memorial Tomb 43rd Year Guru Pooja festival at Needamangalam Taluk, Thiruvarur District on 03.07.2025 between 6 pm and 11 pm.

2. Heard both sides and perused the materials available on record.

3. On a reading of the materials available on record, it shows that the petitioner has not produced all materials to show that, from time immemorial, i.e., for the past 43 years, they are conducting cultural programme in the event of Guru Pooja stated above.

4. It is strange to hear that "Samadhi" in the event of Guru Pooja, are being conducted as cultural programme in the name of "Aadal Paadal" Unless the petitioner establishes that such customs and conventions are there, the Court is not inclined to grant such relief sought for by the petitioner.

5. However, on a reading of the impugned rejection order, shows that it is a non-speaking order. But the respondent-Police is directed to pass speaking order in future. However, the petitioner is not entitled to the relief sought for.

6. The petitioner is at liberty to approach the Civil Court to establish their customs and get appropriate remedy before the Civil Court. With this liberty, this petition is dismissed. Consequently, W.P.M.P.Crl.No.60 of 2025 is closed.
