Respondent(s) PRAYER: This Criminal Miscellaneous Petition filed under Section 528 of B.N.S.S. to permit the petitioner to travel abroad for a period of thirty-two (32) days from 26.06.2025 to 28.07.2025 pending disposal of the case in Crl.O.P.No.206 of 2024 on the file of this Court. ORDER
This Criminal Miscellaneous Petition has been filed by the petitioner to permit him to travel abroad for a period of thirty-two (32) days from 26.06.2025 to 28.07.2025 pending disposal of the case in Crl.O.P.No.206 of 2024 on the file of this Court.
2. The learned Counsel for the petitioner submitted that the petitioner has
filed a petition before this Court in Crl.O.P.No.206 of 2024 to direct the first respondent to withdraw the Look-Out Circular issued against him and the same is pending. Now his sister's daughter has completed her undergraduate degree in Scots and Engish Law at the University of Strathclyde, Glasgow, and her convocation ceremony is scheduled to be held on 01.07.2025. Hence, the petitioner being the guardian of his sister's daughter, is required to travel to UK. Hence, pending O.P., the present petition is filed seeking permission to travel abroad.
3. The learned Additional Solicitor General appearing for the respondents submitted that on earlier occasion also, the petitioner was permitted to travel abroad with certain conditions vide order dated 24.04.2025 in Crl.M.P.No.8392 of 2025 and he has no objection if the petitioner is ready to adhere to the same conditions.
4. At this juncture, the learned counsel for the petitioner submitted that the petitioner is ready to comply with the said conditions.
5. In view of the above, the petitioner is permitted to visit abroad for a period of thirty-two (32) days from 26.06.2025 to 28.07.2025 subject to
condition that the petitioner should adhere to the conditions already imposed by this Court in Crl.M.P.No.8392 of 2025 dated 24.04.2025 as follows:
1. The petitioner shall inform his place of stay in abroad and furnish the correct contact number before visiting abroad.
2. The petitioner shall report before the High Commissioner of India at United Kingdom about his place of stay and movements.
3. As soon as he return India, he shall report before the Investigating Officer about his return and co-operate with the investigation.
4. The petitioner shall always keep his E-mail open for access by the first respondent.
6. With the above directions, this Criminal Miscellaneous Petition is disposed of.
