The present Miscellaneous Petition is filed seeking extension of time for complying the conditions imposed while granting suspension of sentence by this Court vide orders dated 23.01.2023 in Crl.M.P.No.662 of 2023 in Crl.A.No.56 of 2023 and the relavant paragraph is extracted hereunder:

"7.Accordingly, the relief of suspension of sentence alone is granted on the following conditions: i. The petitioner shall surrender before the Trial Court within two weeks from the date of receipt of a copy of this order and on such surrender, the petitioner shall execute a bond for a sum of Rs.10,000/- (Rupees ten thousand only) along with two sureties, each, for a likesum to the satisfaction of Sessions Judge, Mahalir Neethi Mandram, (FTMC),Udhagamandalam, Nilgiris;

ii. The petitioner and the sureties shall affix their photograph and Left Thumb Impression in the bond and the Trial Court may obtain a copy of his Aadhar card or Bank pass Book to ensure his identity;

iii. The petitioner shall appear before the trial Court as and when required."

2. The learned counsel for the petitioner contended that the erstwhile counsel for the petitioner expired and therefore the petitioner was unable to surrender before the trial Court within the time stipulated by this Court.

3. Considering the submission made by the learned counsel for the petitioner, this Court is inclined to allow this petition and two weeks time is granted to comply with the conditions imposed by this Court on 23.01.2023 in Crl.M.P.No.662 of 2023 in Crl.A.No.56 of 2023 The petitioner is directed to surrender before the trial Court within two weeks from today.
