..Respondents Prayer: This writ petition has been filed under Article 226 of the Constitution of India praying for issuance of a writ of mandamus directing the 1st respondent to consider and pass appropriate orders on the petitioner's representation dated 10.10.2025 and consequently to direct the 1st respondent to grant pensionary benefits for one notional increment sanctioned to the employees retired prior to 31.12.2014 in G.O.Ms.No.140 Finance (Pay Cell) Department dated 25.04.2018 as was granted to the employees retired after 31.12.2014 in G.O.Ms.No.311 Finance (CMPC) Department dated 31.12.2014 and as directed by this Court in W.P.No.15107 of 2016 dated 16.08.2017, within a time frame as may be fixed by this Court.

ORDER

The writ petition has been filed to direct the first respondent to consider and pass appropriate orders on the petitioner's representation dated 10.10.2025 and to consequently direct the 1st respondent to grant pensionary benefits for one notional increment sanctioned to the employees retired prior to 31.12.2014 in G.O.Ms.No.140 Finance (Pay Cell) Department dated 25.04.2018 as was granted to the employees retired after 31.12.2014 in G.O.Ms.No.311 Finance (CMPC) Department dated 31.12.2014 and as directed by the this Court in W.P.No.15107 of 2016 dated 16.08.2017, within a time frame as may be fixed by this Court.

The petitioner was promoted as Deputy Collector on 20.07.2008 and retired from service on attaining superannuation on 30.06.2009 and pension payment order was issued to him in P.P.O.No.C/209751/REV. Based on the order passed by this Court in W.P.No.15107 of 2016 dated 16.08.2017, the amendments were made in G.O.Ms.No.311 Finance (CMPC) Department through G.O.Ms.No.140 Finance (Pay Cell) Department, dated 25.04.2018 thereby extended the benefit of annual increment to all other similarly placed pensioners who retired prior to 31.12.2014 and completed one full year of service prior to the retirement, notionally with effect from the date of the retirement for the purpose of revision of pension with monetary benefits prospectively with effect from 31.12.2014 i.e., from the date of issuance of the

said G.O.Ms.No.311. Hence, the petitioner is also entitled for pensionary benefits. However, G.O.Ms.No.140 did not sanction the pensionary benefits, but sanctioned pension along, which resulted in depriving of the petitioner's rightful pensionary benefits including Death-cum-Retirement Gratuity and commutation of pension. Hence, he made representations and the last of which is on 10.10.2025, for which there is no response till date. Therefore, the petitioner is before this Court.

3. Heard the learned counsel on either side and perused the materials available on record.

Considering the relief now sought for by the learned counsel for the petitioner, this Court, without going into the merits of the case, directs the first respondent to consider the petitioner's representation dated 10.10.2025, on merits and in accordance with law and to pass appropriate orders, within a period of eight weeks from the date of receipt of a copy of this order.
