(Crime.No.263 of 2026) ..Respondent Prayer: Criminal Original Petition filed under Section 483(1) of BNSS, praying to modify the condition "the Petitioner/Accused each shall produce two sureties in that one surety must be a close relative (blood relative) another surety must be a local surety or a person providing proper proof and also the petitioner/accused must provided an insolvency certificate for the surety" in the order passed by the learned Judicial Magistrate, Palladam in Crl.M.P.No.282 of 2026 dated 05.06.2026.

ORDER

This Criminal Original Petition has been filed by the petitioners seeking to modify the condition imposed by the learned Judicial Magistrate, Palladam in Crl.M.P.No.282 of 2026 dated 05.06.2026 that "the Petitioner/Accused each

shall produce two sureties in that one surety must be a close relative (blood relative) another surety must be a local surety or a person providing proper proof and also the petitioner/accused must provided an insolvency certificate for the surety".

2. The learned Counsel for the petitioners submits that the petitioners are unable to secure sureties within the jurisdiction of the Magistrate Court. However, he submits that they can arrange for the same from their native place.

3. Considering the above submission, this Court is inclined to modify the condition imposed by the learned Judicial Magistrate, Palladam in Crl.M.P.No.282 of 2026 dated 05.06.2026. Accordingly, the condition that "the Petitioner/Accused each shall produce two sureties in that one surety must be a close relative (blood relative) another surety must be a local surety or a person providing proper proof and also the petitioner/accused must provided an insolvency certificate for the surety" is modified to the effect that "the petitioner/accused shall produce two sureties out of whom one should be a blood relative, and the petitioner/accused shall provide an insolvency certificate for the sureties". Two weeks time is granted to comply with the modified condition.
