ORDER

This petition is filed seeking direction to the second respondent to complete the investigation and file a final report in respect of Crime No.423 of 2011.

2. The petitioner had lodged a complaint and a case in Cr.No.423 of 2011 for offence under Section 420, 294(b) and 506(ii) IPC was registered but, thereafter no action has been taken. Hence the present petition.

3. This Court on 19.06.2026 had directed the Inspector of Police, Pazhavanthangal Police to be present before this Court today along with CD file. Today he is present along with the CD file.

4. The learned Counsel for Govt. of Tamil Nadu for R1, on perusal of CD file, submitted that in this case investigation has been completed and charge sheet has been filed as early as 15.03.2017 and the same has been taken on file in C.C.No.274/2017 and now charge sheet is pending before the learned Judicial Magistrate - I, Alandur. The case is periodically adjourned for service of summons and the next hearing date is 30.06.2026.

5. It is shocking to know that an accused who is residing at Alwarpet which is well within the City limit, is unable to be served for more than 9 years.

Whether the respondent police has taken any steps in this regard and whether at all monthly review meetings have been regularly held by the higher officials such the Assistant Commissioner of Police and Deputy Superintendent of Police to find out the long pendency and stage of the cases, is not known. Equally the Judicial Magistrate-I, Alandur is also responsible for ensuring the service of summons to the accused.

6. In view of the above, this Court directs the Judicial Magistrate - I, Alandur to ensure the service of summons on the accused and after the appearance of the accused, to complete the trial as expeditiously as possible, preferably, within a period of six months.

7. The Deputy Commissioner of Police, St.Thomas Mount, Chennai is directed to monitor this case and ensure the service of summons on the accused and to close the file within the above said period.
