ORDER

The petitioner, who was arrested and remanded to judicial custody on 04.05.2025, for the offence punishable under Section 296 (b) and 103 (1) of BNS in Crime No.76 of 2025, registered on the file of the respondent, seeks bail.

2. The case of the prosecution is that the petitioner is the husband of the deceased Vijayashanthi and they have two children. It is alleged that three months prior to the incident, the petitioner began to suspect character and conduct of the deceased. On 04.05.2025 at about 8.00 a.m., he allegedly locked the bedroom from inside and stabbed the deceased using knife indiscriminately. He later attempted to portray the incident as an act of self defense by also inflicting injuries upon himself. Subsequently, neighbours arrived at the scene and took both the deceased and the petitioner to the hospital. Hence, the case. 3.The learned counsel for the petitioner submitted that the petitioner is an innocent person and he has been falsely implicated in this case. He further submitted that petitioner is in judicial custody from 04.05.

2025 and hence further custody of the petitioner is not required. Hence, he prayed for grant of bail to the petitioner. 4.The learned Government Advocate (Criminal side) reiterated the prosecution case and submitted that the petitioner is the husband of the deceased and they have two children. Three months back prior to the incident, the petitioner started to suspect character and conduct of the deceased. On 04.05.2025 at about 8.00 a.m.

inflicted injury. Thereafter, neighbours had come taken both the deceased and the petitioner to the hospital. While treatment was given for his injured wife to save her life, the petitioner took surgical scissors and stabbed the deceased on her neck and ensured that she is dead. The incident has been witnessed by one of the child and had also given statement under Section 164 confirming the same.

5.Heard the learned counsels on either side and perused the materials on record. 6.Considering the facts and circumstances of the case, the nature of offence and since custodial interrogation of the petitioner is very much required, this Court is not inclined to grant bail to the petitioner. Accordingly, this Criminal Original Petition is dismissed. 31-07-2025 ep To
