PRAYER: Criminal Original Petition filed under Section 528 of BNSS 2023, to issue a direction directing the first to fourth respondents to grant adequate police protection to protect the life and liberty of the petitioner and his family at fourth to Chinna Karadiyur village, Pochampalli pursuant to the actions of fifth to seventh respondents herein and their men in connection with Crime No.153 of 2025 on the file of the Inspector of Police, Pochampalli Police station, Krishnagiri based on the representation dated 16.5.2025.

O R D E R

This Criminal Original Petition has been filed to issue a direction directing the first to fourth respondents to give adequate police protection to protect the life and liberty of the petitioner and his family pursuant to the actions of fifth to seventh respondents herein and their men in connection with Crime No.153 of 2025 on the file of the Inspector of Police, Pochampalli Police station, Krishnagiri based on the representation dated 16.5.2025.

2. Heard the learned counsel appearing for the petitioner and the learned Government Advocate (Crl.Side) appearing for the respondentPolice and perused the materials available on record.

3. Since there is no adverse order is being passed as against the private respondents, notice to the private respondents is dispensed with.

4. The learned Senior Counsel appearing for the petitioner submitted that the petitioner is a social activist and physically challenged person. The petitioner objected the illegal quarry activities done by the respondents 5, 6 and 7 and lodged a complaint against them before the respondent Police. Due to which, the accused persons made life threat to the petitioner. Hence, the petitioner approached this Court by way of this petition seeking police protection.

5. Learned Government Advocate (Crl.Side) appearing for the respondent-Police submitted that based on the complaint given by the petitioner,a case was registered in Crime No.153 of 2025 on 07.05.2025 and the same is pending.

6. Considering the submissions made by the learned counsel on either side and also considering the facts and circumstances of the case, this Court directs the respondent-Police to give adequate police protection to the petitioner. Further, the respondent-Police is also directed to expedite the investigation in Crime No.153 of 2025 and file a charge sheet as early as possible.

7. With the abovesaid direction, this Criminal Original Petition is disposed of.
