As seen from the earlier proceedings, Application No.1875 of 2022 has already been disposed of by this Court by its order dated 23.08.2022. Since the Application No.1875 of 2022 has already been disposed of, Registry is directed not to list the said application in the future hearing dates.
2. Application No.4135 of 2023 has been filed seeking to condone the defect in filing the Judges Summons and affidavit in single side. The learned counsel for the respondent has not raised any objection for allowing this application.
3. This Court is also satisfied with the reasons contained in the affidavit filed in support of this application. Accordingly, Application No.4135 of 2023 is allowed as prayed for. Registry is directed to number the applications if it is otherwise in order and list the same on the next hearing date.
4. Application No.3601 of 2023 has been filed seeking to file 1/3
additional documents. Application No.3603 of 2023 has been filed seeking to amend the suit to bring on record the current registered office address; and also to bring on record the registration of the plaintiff's mark. Application No.5163 of 2023 has been filed seeking to permit the applicant/plaintiff to amend the prayer in the plaint.
5. The learned counsel for the respondent/defendant has not raised any objection for allowing these applications.
6. This Court is also satisfied with the reasons contained in the affidavit filed in support of these applications as sufficient cause has been shown for allowing these applications as prayed for. Accordingly, Application Nos.3601, 3603 and 5163 of 2023 are allowed as prayed for, without prejudice to the rights and contentions of the defendant in the main suit. Applicant is directed to carry out the necessary amendment accordingly.
Post the matter for hearing on 09.11.2023.
