PRAYER:
Writ Petition is filed under Article 226 of Constitution of India praying to issue a Writ of Mandamus directing the Respondents particularly the Respondents 3 and 4 to cancel the allotments and computerized Patta issued to 71 individuals, out of 86 allottees, rest of the lands (except 15 persons constructed houses) and restore the same after cancelling the land acquisition proceedings and payment of fair compensation for the land acquired so far (expect 15 persons' land) to the petitioners for the land property, situated at Udaiyanachi Village (Colony), Kallakurichi, Taluk and District, Patta No.118, comprised in Ayan Punja S.No.241/1 to an extent of Acre 1.85 cents and Ayan Punja S.No.242/2, to an extent of Acre 1.07 cents and in all totaling to an extent of Acres 2.92 cents by considering the Petitioners' legal notice dated 28.04.2025 and the representation dated 27.05.2025 to the Respondents For Petitioners : Mr.R.Thanjan For Respondents For R1 to 3 : Mr.N.Naveen Kumar, Government Advocate 2/6

This writ petition has been filed for direction to respondents 3 and 4 to cancel the allotment and pattas issued in favour of 86 beneficiaries and to restore the subject property in favour of the petitioner.

The petitioner owned land comprised in Ayan Punja survey No.241/1 to an extent of 1.85 acres and Ayan Punja survey No.242/2 to an extent of 1.07 acres, in total 2.92 acres situated at Udaiyanachi Village, Kallakurichi. The said land was acquired for the purpose of welfare of adidravidar and tribal people of Kallakurichi District. After acquisition, the subject lands were assigned to 86 beneficiaries. The only ground raised by the petitioner is that out of 86 allottees, 71 individuals did not construct their respective houses as per the assignment patta. Therefore, the petitioner submitted representation to restore the land in his favour. Admittedly, the subject land was assigned in favour of 86 beneficiaries. If at all any beneficiary has failed to construct a house and failed to comply any of the conditions, the authorities may cancel their assignment and allot in favour of other beneficiaries. Therefore, the petitioner cannot seek for restoration of the said land from the acquisition proceedings. 3/6

In view of the above discussion, the representation submitted by the petitioner seeking cancellation of allotment and issuance of patta to the beneficiaries cannot be considered. As such, this writ petition is devoid of merits and the same is liable to be dismissed. Accordingly, this writ petition is dismissed.
