The instant writ petition has been filed with a prayer for issuing a certiorarified Mandamus, to call for the entire records relating to the impugned order passed by the 1st respondent in his proceedings Sae.Mu.A.No.AD1/37064/2024, dated 28.04.2025 and quash the same and consequently directing the respondents to sanction and disburse the petitioner's retirement benefits to the petitioner.
2. The learned counsel for the petitioner submits that the petitioner was terminated from service on account of his unauthorized absence for more than 3193 days. It is the submission of the petitioner that, though he was absent since 2014, no termination order had been passed, and only when he approached the authorities for re-employment, such termination order came to be passed.

3. Heard the learned counsel for the petitioner and the learned counsel for the respondents and perused the materials available on records.
4. It is an admitted fact that the petitioner was unauthorizedly absent from 01.08.2014 to 30.04.2023, for almost 3193 days. Therefore, the mere delay in passing the termination order will not confer any benefit upon the petitioner to seek quashing of the impugned order. Furthermore, there is an abundant material on record to arrive at a conclusion that the order passed by the disciplinary authority is based on the available records and also on the admission made by the petitioner regarding his absence.
5. Hence, this Court do not find any merits in the present writ petition. Accordingly, the Writ Petition stands dismissed. No costs. 23.06.2025 jas Index : Yes/No Speaking order /Non Speaking Order 3/5
