CRL.O.P.No.22545 of 2016 Dr.P.DEVADASS, J., Petition for anticipatory bail in Crime No.2 of 2016 for offence under Sections 408, 467, 468, 471, 477(A) r/w 34 of I.P.C.

2. Heard both sides.

3.The petitioner was the Secretary of Primary Agricultural Co-operative Credit Society, Nallur. He is alleged to have misappropriated Society's property worth Rs.38 Lakhs. Earlier, Rs.16 Lakhs has been paid by the co-accused. The petitioner remitted Rs.17 Lakhs and odd to the Society. In the facts and circumstances, almost entire amount is recovered. Already there is Surcharge proceedings and as against that CMA is pending before Co-operative Tribunal/ District Judge.

4. In the facts and circumstances and considering the nature of the allegation made, I am inclined to grant him anticipatory bail.

5. Ordered as under:- (i) Anticipatory bail granted.

Dr.P.DEVADASS, J., pri/dp (ii) Petitioner shall surrender before the learned Judicial Magistrate - II at Poonamallee, within 15 days of receipt of a copy of the order;

(iii) Petitioner shall execute a bond for Rs.15,000/- (Rupees Fifteen Thousand only) with two sureties each for a like sum to the satisfaction of the said Magistrate;
