ORDER
The transfer petition has been filed by the husband seeking transfer of H.M.O.P.No.2699 of 2021, filed by the wife for restitution of conjugal rights on the file of the IV Additional Family Court, Chennai to the file of the Subordinate Court, Alandur to be tried with H.M.O.P.No.1442 of 2021, which is the petition filed by the petitioner husband seeking divorce.
2. The respondent wife has no objection for the matter being transferred.
3. It is informed that the respondent wife has been set ex parte in the petition filed by the husband and an application is being filed for setting aside the ex parte order.
4. The learned counsel for the petitioner husband assures the Court that they would have no objection to the ex parte order being set aside and request that the matter may be first referred to mediation.
5. Taking into account the submission of the learned counsel, the Transfer Civil Miscellaneous Petition is allowed. https://hcservices.ecourts.gov.in/hcservices/
H.M.O.P.No.2699 of 2021, pending on the file of the IV Additional Family Court, Chennai is withdrawn and transferred to the file of the Subordinate Court, Alandur. The learned Subordinate Judge. Alandur shall first endeavour to bring about settlement through mediation between the parties, failing which the matter may be proceeded with in the manner known to law.
