The petitioner herein seeks a direction to respondents to pay compensation for the land measuring to an extent of 999 sq.mtrs., situated in S.No.128/1B3C of Chettikuppam Village, Marakanam Taluk, Villupuram District.

2. It is the case of the petitioner that he is the owner of the said property and the same has been acquired for laying National Highways. The petitioner made several representations to the respondents requesting them to pay compensation to the land acquired from him. However, there was no positive response from the respondents. Hence, the petitioner has come by way of this writ petition.

3. Mr.A.Selvendran, learned Special Government Pleader takes notice for the respondents, on instructions, submitted that the patta for the land acquired stands in the names of several persons. In view of the rival claim, the matter has to be referred to the Civil Court for determination of apportionment.

4. In view of the aforesaid submission made by the learned Special 2/4

Government Pleader for the respondents, the 1st respondent is directed to refer the matter to the Civil Court decision under Section 3H (4) of the National Highways Act, 1956, within a period of four weeks from today.
