PRAYER: The Criminal Miscellaneous Petition has been filed under Section 528 of Cr.P.C. to modify the condition imposed in para No.7(iv) order passed in Crl. O.P. No.12957 of 2026.

ORDER
This petition has been filed to modify the condition imposed in Crl.O.P.No.12957 of 2026 dated 20.05.2026 directing the Petitioner to appear before the Judicial Magistrate, Gudiyatham, Vellore District on all working days at 10.30 a.m. until further orders.
2. The learned counsel for the petitioner submitted that the petitioners have complied the conditions imposed by this Court in the above Crl. O.P. No.12957 of 2026. He would further submit that the petitioners were arrested in another case in Cr. No.133 of 2026 and they were also released on bail in the said case with condition to appear before the respondent police daily at 10.30 a.m. until further orders and in view of the condition to appear before the Judicial Magistrate, Vellore in the present case and they have been regularly appearing before the Judicial Magistrate Vellore since 01.06.2026, they are not in a position to appear before the respondent police in the said case in Cr. No.133 of 2026 and hence, prays that the condition in the present case may be modified to sign before the respondent police.
3. The learned Government Advocate appearing for the respondent Police has not raised any serious objection to modify the condition and further she would fairly admit that the petitioners have been complying the condition regularly.
4. From the submissions made on either side and since the petitioners have been complying the condition without any violation, this Court is inclined to modify the condition imposed in Crl.O.P.No.12957 of 2026 dated 20.05.2026. Accordingly, the condition that "the petitioners shall sign before the Judicial Magistrate, Gudiyatham, Vellore District" is modified to the effect that "the petitioners shall appear and sign before the respondent police daily at 10.30 a.m. for a period of two weeks and thereafter, as and when required by the respondent police for interrogation". The other conditions imposed earlier shall remain unaltered.
5. Accordingly, this criminal miscellaneous petition is ordered. 18-06-2026 MJS Note:
