This application has been filed by the applicant to condone the delay of 620 days for filing written statement of the first defendant. 2/6

2. According to the applicant, he is the first defendant in the main suit. The plaintiff has filed the suit for damages and for permanent injunction. Summons was served to the first defendant. In the suit summons, no copies of documents have been served and thereafter, he obtained copy and thereby there is a delay in filing written statement.

3. The other side had not filed counter. However, strongly objected to allow this application.

4. Considering the reasons stated in the affidavit and facts and circumstances of the case, in order to give a chance to the first defendant to put forth his defense and considering the number of days in delay, it is appropriate to allow this application. Accordingly, this application is allowed. Post the matter on 11.12.2025.
