ORDER

This writ petition is filed for the following relief: "directing the first respondent herein to pay interest for the delayed payment made to the petitioners in respect of Gratuity, Commutation, Surrendered leave, Provident Fund and Earned Leave."

2. The brief facts which are culminated in the filing of this writ petition are set out below:

2.1. It is the case of the petitioners that they joined the service of the first respondent Corporation and retired from service on attaining the age of superannuation on various dates. The respondents settled the Gratuity,

Commutation, Surrendered Leave, Provident Fund and Earned Leave, with a delay. Therefore, the respondents are legally bound to pay interest to the petitioners. Hence, the petitioners made representations to the respondents to pay the interest for the belated payment of the petitioners' Gratuity, Commutation, Surrendered Leave, Provident Fund, and Earned Leave. Since there is no response, the petitioners are before this Court.

3. Heard the learned Counsel on either side and perused the materials available on records.

4. Admittedly, the Gratuity, Commutation, Surrendered Leave, Provident Fund and Earned Leave has been paid belatedly for no fault of the petitioners. Therefore, the petitioners are entitled to interest on the same. Therefore, the Writ petition is disposed of with a direction to the respondents to disburse the 6% interest for belated payment of Gratuity, Commutation, Surrendered Leave, Provident Fund, and Earned Leave, within a period of one (1) month from the date of receipt of a copy of this order. No costs. Consequently, connected miscellaneous petition in W.M.P.No.24845 of 2026 is ordered subject to payment of separate Court fee.
