The petitioner, who apprehends arrest at the hands of the respondent police for the alleged offence punishable under Section 6(4) Tamil Nadu Schedule Commodities (RDCS) order 1982 r/w. Section 7(i)(a)(ii) of the Essential Commodities Act, 1955 in Crime No.126 of 2022, seeks anticipatory bail.

2. The case of the prosecution is that the petitioner along with another accused were found in illegal possession of 100 Kgs of PDS rice. Hence the complaint.

3. The learned counsel appearing for the petitioner would submit that the petitioner is an innocent person and she has not committed any such offence as alleged by the prosecution and she has been falsely implicated in this case. Hence, he prays to grant anticipatory bail to the petitioner.

4. The learned Government Advocate (Crl.Side) appearing for the respondent would submit that there are totally 2 accused in which the petitioner is arrayed as A2. The petitioner along with another accused were found in illegal possession of 100 Kgs of PDS rice He would further submit that there are four previous cases against the petitioner. Hence, he vehemently opposed to grant anticipatory bail to the petitioner.

5. Considering the facts and circumstances of the case and the submissions made by the learned counsel, this Court is not inclined to grant anticipatory bail to the petitioner.

6. Accordingly, this Criminal Original Petition is dismissed. 22.08.2022 Vv 2/3
