Writ Petition filed under Article 226 of the Constitution of India praying for issuance of a writ of mandamus directing the respondents to correct the name of the village in the Encumbrance Certificate issued in respect of the property Survey No.477/13, Melapudi Village, Pallipattu Taluk, Tiruvallur District under Partition Deed dated 17.05.2023 registered as Document No.846/2023 at the office of the Sub-Registrar, Pallipattu, Tiruvallur District as Melapudi instead of Mallpudi and the name of T.Shanthi (o/rhe;jp) instead of Santhi (o/re;jp) in the Northern boundary of Schedule-1 boundary details given in respect of portion allotted to my brother G.Bharadwaj.

By consent of learned counsel on both sides, this writ petition is taken up for final disposal at the admission stage itself.

The relief sought in this writ petition is to direct the respondents to correct the name of the village in the Encumbrance Certificate issued in respect of the property comprised in Survey No.477/13, Melapudi Village, Pallipattu Taluk, Tiruvallur District under Partition Deed dated 17.05.2023 registered as Document No.846/2023 at the office of the Sub-Registrar, Pallipattu, Tiruvallur District as Melapudi instead of Mallpudi and the name of T.Shanthi (o/rhe;jp) instead of Santhi (o/re;jp) in the Northern boundary of Schedule-1 boundary details given in respect of portion allotted to petitioner's brother G.Bharadwaj.

The learned counsel for the petitioner submitted that the petitioner and her brother Mr.G.Bharadwaj partitioned the property comprised in Survey No.477/13 situated at Melapudi Village, Pallipattu Taluk, Tiruvallur District by way of Partition Deed dated 17.05.2023 registered as Document No.846 of 2023 on the file of 3rd respondent. 2/7
3.1. It is further submitted by the learned counsel for the petitioner that when the petitioner downloaded the Encumbrance Certificate in respect of the subject property on 09.06.2023, she found that there are some typographical mistakes in the Encumbrance Certificate:

2. Schedule - 1 details:

Therefore, the petitioner and her brother executed a Rectification Deed which was registered as Document No.2185 of 2023 dated 22.11.2023 on the file of the 3rd respondent.

The learned counsel for the petitioner submitted that on 03.12.2023, petitioner filed an Online Index Correction Petition No.ICP/Pallipattu/34/2023, for correcting the above mistakes in the Encumbrance Certificate. That apart, the petitioner sent several e-mails and letters to the respondents, to rectify the mistakes in the Encumbrance Certificate.

3.3. It is submitted by the learned counsel for the petitioner that when the petitioner verified the Encumbrance Certificate on 02.08.2024, she found that the above mistakes still existed. It is submitted that though the petitioner repeatedly requested the respondents to rectify the aforesaid mistakes in the Encumbrance Certificate, the respondents have not taken any steps to correct the mistakes in the Encumbrance Certificate. 3.4. The learned counsel for the petitioner also submitted that as per the direction of the 3rd respondent, the petitioner filed a new Online Index Data Correction Petition No.ICP/Pallipattu/12/2025 on 02.04.2025, for correcting the mistakes in the Encumbrance Certificate, but, in the Encumbrance Certificate downloaded by the petitioner on 28.05.2025, the aforesaid mistakes still existed which necessitated the petitioner to file this writ petition.
4. The learned Government Advocate appearing for the respondents submitted that the respondents would consider the petitioner's Online Index Data Correction Petition No.ICP/Pallipattu/12/2025 dated 02.04.2025 and pass appropriate orders, within a time frame to be fixed by this Court. 4/7
5. The above submission made by the learned Government Advocate for the respondents was agreed to by the learned counsel for the petitioner.

In view thereof, this Writ Petition stands disposed of with the direction to the respondents to consider the petitioner's Online Index Data Correction Petition No.ICP/Pallipattu/12/2025 dated 02.04.2025 and pass appropriate orders, after issuing notice to the petitioner and any other interested parties, within a period of four weeks from the date of uploading of the web copy of this order without waiting for the receipt of a certified copy of this order. It is made clear that this Court has not expressed any opinion with regard to the merits of the case and it is open to the concerned respondents to consider the matter on its own merits and in accordance with law. No costs.
