ORDER
The present Writ Petition has been filed seeking the issuance of a Writ of Certiorarified Mandamus to call for the records relating to the proceedings of the 3rd respondent in rejection order No. 2026/0105/01/022504 dated 21.05.2026, to quash the same as illegal, arbitrary, and without jurisdiction, and consequently direct the respondents to effect mutation in the revenue records and issue a patta in the name of the petitioner in respect of Survey No. 379/3A situated at Arungulam Revenue Village, Tiruttani Taluk, Tiruvallur District.
2. The case of the petitioner is that they purchased the subject property by virtue of a registered Sale Deed dated 26.08.2002 and have been in continuous possession of the same ever since. The petitioner submitted an application for the issuance of a patta for Survey No. 379/3A. However, the 3rd respondent rejected the application on the ground that the petitioner is not in possession of the property. The petitioner contends that this rejection was passed without conducting any inquiry and without affording him an opportunity for a personal
hearing, in total violation of the principles of natural justice. Challenging the said rejection, the petitioner has moved this Court.

The learned Government Counsel appearing for the respondents fairly submitted that since no prior notice or personal hearing was afforded to the petitioner, the impugned order may be set aside and the matter may be remitted back to the 3rd respondent for fresh consideration in accordance with the law.

Considering the submissions made by the learned counsel for the petitioner and the learned Government Counsel appearing for the respondents, and in view of the fact that the impugned order was passed in violation of the principles of natural justice, the impugned order dated 21.05.2026 passed by the 3rd respondent is hereby set aside. The matter is remanded to the 3rd respondent for fresh consideration. The 3rd respondent is directed to issue due notice to the petitioner, afford him a reasonable opportunity for a personal hearing, conduct a thorough field verification regarding the possession of the property, and issue patta in the name of the petitioner. This entire exercise shall be completed by passing a detailed speaking order within a period of eight (8) weeks from the date of receipt of a copy of this order.
5. With the above directions, this Writ Petition stands disposed of. There shall be no order as to costs.
