The petitioner, who apprehends arrest at the hands of the respondent police for the alleged offence punishable under Sections 294(b), 420, 495, 506(i), 354 of IPC, in Crime No.8 of 2024, on the file of the respondent police, seeks anticipatory bail.

2. The case of the prosecution is that the first accused/Sathya, who is a women cheated various persons. Further, the first accused has married the defacto complainant with the help of this petitioner and recieved money from himm cheated him. Hence, the complaint.

3. The learned counsel appearing for the petitioner submitted that the petitioner is an innocent person and she has been falsely implicated tin this case. He further submitted that the petitioner is a broker, a false case has been given. He further submitted that the petitioner is no aware of the marriage proposals with A1 and the defacto complainant. He further submitted that the petitioner is ready to abide by any stringent

conditions that may be imposed by this Court. Hence, he prays for grant of anticipatory bail to the petitioner.

4. The learned Government Advocate (Crl.Side) appearing for the respondent submitted that the petitioner along with other accused persons have cheated the defacto complainant and the investigation is still pending. Hence, he prayed for dismissal of this petition.

5. The learned counsel for the Intervenor/defacto complainant submitted that A1 has already married to various person and cheated the defacto complainant. He further submitted that the defacto complainant has paid a sum of Rs.37,000/- to the petitioner as broker commission. After the defacto complainant came to know that the petitioner along with A1 have cheated him, due to the frustration, the grand father of the defacto complainant had committed suicide. Hence, he prayed for dismissal of this petition.

6. Considering the facts and circumstances of the case and also the fact that the petitioner has colluded with A1, cheated the defacto complainant and the investigation is still pending. Further, the petitioner has involved in serious offence, this Court is not inclined to grant anticipatory bail to the petitioner.

7. Accordingly, this Criminal Original Petition is dismissed. 29.07.2024 msrm
