G.K.ILANTHIRAIYAN, J.

The petitioner, who apprehends arrest at the hands of the respondent police for the offences punishable under Sections 6(4) of Tamil Nadu Scheduled Commodity (RDCS) Order, 1982 and r/w Section 7(1)(a)(ii) of the Essential Commodities Act, 1955, in Crime No.98 of 2022, seeks anticipatory bail.

2. The case of the prosecution is that the petitioner along with other accused was found in possession of 9500 Kgs of PDS rice. Hence the case.

3. The learned counsel appearing for the petitioner would submit that the petitioner has been falsely implicated in this case and he is no way connected with the alleged offence. Hence, he prays to grant anticipatory bail to the petitioner.

4. The learned Government Advocate (Crl.side) submitted that the petitioner, along with other accused, was found in possession of 9500 Kgs of PDS rice. He would further submit that there is one previous case pending against the petitioner. Earlier anticipatory bail petition filed by the petitioner before this Court in Crl.O.P.No.14705 of 2022 was dismissed on 27.06.2022. Hence he vehemently opposed to grant anticipatory bail to the petitioner.

This Court, taking into consideration the facts and circumstances of the case and the bad antecedents of the petitioner, had dismissed the earlier anticipatory bail petition and now again he has filed a petition seeking anticipatory bail. There is no change of circumstances to entertain the second anticipatory bail petition. Hence, this Court is not inclined to grant anticipatory bail to the petitioner.

6. Accordingly, this Criminal Original Petition is dismissed. 12.09.2022 Lpp/vsn
