The Court summons returned for want of time. Affidavit of service filed by the plaintiff regarding the private notice. The annexure to the affidavit indicates that the notice sent to the defendant returned as "refused". The Registry Note indicates that the suit summons through court returned for want of time.

2.In the above said circumstances, the interim order passed on 22.12.2020 is made absolute, since the respondent has refused to receive the notice and not inclined to contest the matter.

3.Registry is directed to re-issue the summons to the respondent for the hearing date 23.08.2021.
