The learned counsel for the applicant / plaintiff has made an endorsement to withdraw this application. Accordingly, this application is dismissed as withdrawn. Though he has asked for liberty to file a fresh

application, such liberty is not granted.

The said application is filed by in the midst of trial which has stopped in the November 2013. Now, the plaintiff has successfully stalled the trial for a period of three years in filing this application. The suit is of the year 2011 and the defendant only be interested in completing the trial.

The Registry is directed to post the suit before the learned Additional Master-IV on 19.12.2016. P.W.1 is directed to file his proof affidavit and submit himself for cross examination. The trial has to be completed on or before 31.03.2016.
