ORDER
This Application has been filed to permit the applicants/ petitioners to sell the subject property mentioned in O.P.No.407 of 2023 to the 'Agreement Purchasers' viz., Mr.H.Ravishankar and Mrs.Chitra Ravishankar according to the MOU dated 21.04.2025.
2. Heard the learned counsel for the applicants.

The learned counsel for the applicants would submit that this Court was pleased to grant Letters of Administration by order dated 23.04.2024 and that the 1st applicant had complied with the order passed by this Court. She would further submit that the applicants are permanent residents of USA and that the Will mentioned property which is an inhabited is now in a dilapidated condition. The 1st applicant had been settled with 25% of the undivided share in the property and the Letters of Administration had been granted only in respect of the remaining 75% in favour of the applicants. She would further submit that the 3rd applicant died as a spinster leaving behind the 1st and 2nd applicants as legal heirs. For a better enjoyment of the property left 2/5
behind by the deceased, she seeks permission of this Court to sell the property.
4. I have considered the submissions made by the learned counsel.

By order dated 23.04.2024 this Court had granted Letters of Administration in respect of the schedule mentioned properties which is 75%, as 25% of the property had been settled in favour of the 1st applicant being the wife of the deceased. The 1st applicant has now sought to sell her share of the property together with 75% of the property for which Letters of Administration has been granted. The 2nd applicant had also filed an affidavit supporting the claim of the 1st applicant. The 3rd applicant is no more, which is also evidenced by the Death Certificate produced by the applicants. The applicants being the legal heirs of the deceased R.Rangarajan are entitled to beneficially enjoy the property which have been left behind by him. In such view of the matter, this Court finds no impediment in ordering the application as prayed for. 3/5
6. In fine, the application is allowed. There shall be no order as to costs.
