O.P.No.95 of 2024 C.V.KARTHIKEYAN, J.

This Original Petition has been filed taking advantage of Section 372 of the Indian Succession Act, 1925 along with relevant rules of the Original Side of Madras High Court seeking Succession Certificate relating to the securities in the name of the late son of the petitioner, S.Padmanabhan, who died intestate on 15.12.2020. His wife, S.Meena, predeceased him on 13.07.2020. They had no children. The petitioner is the only surviving legal heir of the deceased.

2.After following due procedure, the petitioner was directed to tender evidence. Accordingly, she examined herself as PW-1. The death certificates of her son and daughter-in-law were marked as Ex.P1 and P2. The legal heirship certificate of her son was marked as Ex.P3.

3.Taking into consideration the nature of evidence adduced and the documents produced, this Original Petition stands allowed. The Succession Certificate may be issued in favour of the petitioner in accordance with the rules.
