C.M.P.Nos.15798, 15801 & 15803 of 2025 in A.S.No.379 of 2023 Dr.G.JAYACHANDRAN, J.

These three petitions are filed in view of demise of the 2nd respondent. While filing these petitions to bring the legal heirs on record, there was a delay of 393 days.

On perusal of the affidavit filed in support of these petitions, this Court is concerned sufficient cause to condone the delay to set aside the abatement. Accordingly, these Civil Miscellaneous Petitions are allowed. The 13, 14, 15 & 16 respondents, who are the legal heir of the deceased 2nd respondent, brought on record.

3. Notice to the newly impleaded respondents returnable in six weeks. Private notice is also permitted.

4. The learned counsel appearing for the appellant shall file clean amended copy of memo of grounds.

Post the matter after six weeks.
