PRAYER : Petition filed under Article 226 of the Constitution of India praying for issuance of Writ of Certiorari, to call for records of the first respondent in Proceeding No.261/2023-A3 dated 18.01.2024 arising out of Sale Deed dated 02.03.2022 registered as Document No.1585 of 2022 in the Office of the Sub-Registrar of Madukkarai and quash the same and not insist on payment of any additional duty / charges. The present writ petition is filed challenging the proceedings of the first respondent in Proceeding No.261/2023-A3 dated 18.01.2024 arising out of Sale Deed dated 02.03.2022 registered as Document No.1585 of 2022 in the Office of the Sub-Registrar of Madukkarai and quash the same and not to insist on payment of any additional duty / charges.

2. By consent of learned counsel on both sides, this writ petition is taken up for final disposal at the admission stage itself. Since no adverse order is going to be passed, notice to third respondent is dispensed with.

3. After submitting for a brief while, learned counsel for petitioner would submit that he would prefer an appeal against the impugned order in terms of the Act. It is the case of petitioner that the impugned order suffers from glaring error, which is apparent and wholly arbitrary.

4. In view thereof, this Writ Petition stands disposed of by permitting petitioner to file appeal in terms of the Act against the impugned order dated 18.01.2024 within a period of two weeks from the date of uploading of the web copy without waiting for the receipt of certified copy. The petitioner would pay 10% of the impugned demand within a period of one week from the date of uploading of the web copy and enclose the copy of the challan / demand draft with regard to proof of payment of 10% before

the Appellate Authority. If any such appeal is filed, the same shall be entertained and disposed of within a period of four months from the date of filing of the appeal without further reference to limitation. No costs.
