PRAYER: Writ Petition filed under Article 226 of the Constitution of India, to issue a Writ of Mandamus or any other in the nature of Writ directing the respondents particularly the 2nd respondent to reserve any one post in the cadre of Group- D post including Watchmen, Office Assistant, Driver, Record Clerk till the disposal of petitioner representation, dated 27.06.2023 and subsequently direct the 3rd respondent to include petitioner name in the list for regularization of service and forward to 2nd respondent by considering petitioner's representation dated 27.06.2023. ORDER
This Writ Petition has been filed to direct the 2nd respondent to reserve any one post in the cadre of Group-D post including Watchmen, Office Assistant, Driver and Record Clerk till the disposal of petitioner's representation, dated 27.06.2023 and subsequently direct the 3rd respondent to include petitioner name in the list for regularization of service and forward to the 2nd respondent.
2.It is the contention of the Writ Petitioner that he has been working for more than 13 years in the office of the respondents. For regularization, the petitioner has given representation, however, the same has been returned on 23.02.2023 holding that only the controlling authority Page No.2 of 5
alone receive such applications. Hence, the contention of the learned counsel for the petitioner that since the petitioner has worked in various departments in Cuddalore, it is very difficult for him to get details from all the officials.
3.The learned Additional Government Pleader appearing for the respondents submitted that the representation of the petitioner has been submitted to the controlling authorities.
4.In such view of the matter, the petitioner is directed to give fresh representation to the 3rd respondent indicating the places and period of working in various departments. On receipt of such representation, the 3rd respondent shall consider the same and pass orders on merits after getting relevant materials from other departments. Such exercise shall be completed within a period of three months.
5.With the above directions, this Writ Petition is disposed of. No costs.
