ORDER

This Criminal Original Petition has been filed seeking a direction to the second respondent Police not to Harass the petitioner without following due process of law.

2. The learned counsel for the petitioner submitted that the petitioner was previously employed in a Hotel in Chennai. During that period, he became friendly with one Usha and they shared a cordial relationship. Subsequently, she moved to Chandigarh while the petitioner went abroad for employment. Now, a false complaint has been lodged against the petitioner alleging that he married Usha and thereafter deserted her. According to the petitioner, Usha is presently residing in Chandigarh with another person and that he has no connection whatsoever with Usha's daughter.

3. The learned Government Advocate (Crl. Side) submitted that based on on the complaint lodged by Usha, CSR enquiry is pending against the petitioner. The petitioner after sending a letter dated 09.06.2026, not cooperating with the enquiry. The presence of the petitioner is necessary for ascertaining relevant facts and obtaining necessary particulars. If found necessary during the course of the enquiry, a DNA test may also be conducted in accordance with law.

4. In reply, the learned counsel for the petitioner, on instructions, submitted that the petitioner will appear before the respondent Police on 23.06.2026.

5. Considering the submissions made on either side and perusal of materials available on record, this Court directs the petitioner to appear before

the respondent Police on 23.06.2026 and cooperate with the enquiry. In the event of his presence is required thereafter, the respondent Police shall issue appropriate summons in accordance with law. Accordingly, this Criminal Original Petition is disposed of.
