Petition is filed to condone the delay of 135 days in filing the above appeal as against the order dated 13.12.2023 made in W.P.No.30456 of 2023. The respondent has raised objection for condoning the delay in filing the appeal.

Though the respondent has raised objection to condone the delay, in the light of the judgment of the Hon'ble Supreme Court in the case of Esha Bhattacharjee v. Raghunathpur Nafar Academy, (2013) 12 SCC 649 , this court is satisfied with the reasons stated in the affidavit as well as details and particulars that have been furnished in the affidavit to condone the delay of 135 in filing the appeal. In view of the above, the delay is condoned.

The petition is ordered.
