Writ Petition filed under Article 226 of the Constitution of India praying to issue a Writ of Certiorari, calling for the records relating to the notice dated 09.07.2019 issued by the 2nd respondent and quash the same.

The petitioner is aggrieved against the proceedings of the second respondent dated 09.07.2019, informing the petitioner that he has defaulted in paying the vehicle loan and consequently, the respondent is contemplating to seize the vehicle. In the said proceedings, the petitioner was also directed to settle the loan amount within 7 days.

2. After notice to the respondents, the matter was referred to Mediation Centre of this Court. However, it seems that the Mediation failed.

3. Today, the matter is listed again for further hearing. Though the respondents were served with notice, they have not appeared before this Court.

4. However, the learned counsel for the petitioner submitted that the petitioner is willing to settle the loan amount.

5. Needless to say that it is for the petitioner to approach the respondent-Bank and settle the loan amount, when admittedly, the petitioner is due and liable to repay the same. Therefore, this Court is not inclined to retain this writ petition any further, as it is for the petitioner to approach the respondentBank and settle the loan amount. Accordingly, this Writ Petition is disposed of. No costs. Consequently, connected miscellaneous petitions are closed.
