The petitioner, who apprehends arrest at the hands of the respondent police for the alleged offence under Sections 4(1) (a) and 4 (1-A) of TN Prohibition Act, in Crime No.203 of 2023, on the file of the respondent police, seeks anticipatory bail.

2. It is the submission of the learned counsel for the petitioner that petitioner is an innocent person and he has been falsely implicated in this case. Thus, he seeks grant of anticipatory bail for the petitioner. 3.In response, the learned Government Advocate (Crl.Side) opposed this petition and submitted that petitioner was found in illegal possession of 15 litres of illicit arrack, on 17.04.2023, at about 14.00 hours, near Nedumanur Village. Thus, this case was registered against the petitioner, in Crime No.203 of 2023, under Sections 4(1) (a) and 4 (1A) of TN Prohibition Act. He further submitted that petitioner has six previous cases pending against him.

sli 4.Considering the fact that petitioner is a habitual offender having six previous cases pending against him and that investigation in this case is also not completed, this Court is not inclined to grant anticipatory bail to the petitioner. Therefore, this Criminal Original Petition is dismissed.
