The application has been filed to condone the delay of 36 days in preferring the First Appeal.
2. The sole respondent despite serving the notice, has neither chosen to appear in person nor through a counsel.
3. I have gone through the affidavit filed in support of the application for condoning the delay in preferring the first appeal. I have also heard learned counsel for the petitioner and the petitioner has made out sufficient cause for condoning the delay of 36 days. Delay is also not inordinate and has been properly explained.
4. Accordingly, this Civil Miscellaneous Petition is ordered.
