Respondents Prayer : Writ Petition filed under Article 226 of the Constitution of India seeking a Writ of Mandamus, directing the 3rd respondent to execute the Non-Bailable Warrant issued on 25.02.2025 in E.A.No.69 of 2024 by the District Consumer Disputes Redressal Commission, Chengalpattu, and produce the Manger of the 4th Respondent Bank before the Commission within a time fixed by this Court.

ORDER

This Writ Petition is filed for a direction to the third respondent to execute the Non-Bailable Warrant issued as against the fourth respondent bank in E.A.No.69 of 2024.

2. The petitioner availed a housing loan from the fourth respondent. However, there was deficiency of service and the petitioner lodged a complaint before the District Consumer Disputes Redressal Commission, Chengalpattu in C.C.No.62 of 2022. The District Consumer Disputes Redressal Commission directed the fourth respondent to trace out and return the original documents of the petitioner and to pay continuing interest of 10.5% per annum and the calculated sum of Rs.8,00,000/- from 02.11.2021 until the date of returning the original documents, also to pay the compensation of Rs.1,00,000/- for mental agony and to pay a sum of Rs.20,000/- towards proceedings expenses. However, it was not complied with and the petitioner was constrained to file an Execution Petition in E.A.No.69 of 2024, in which, even after receipt of notice, the fourth 2/5

respondent did not appear and as such, the District Consumer Disputes Redressal Commission issued Non-Bailable Warrant as against the fourth respondent and it is pending on the file of the third respondent without execution.

3. The learned Counsel for Government of Tamil Nadu (Criminal Side) for the respondent Nos.1 and 2 submits that the third respondent has no territorial jurisdiction to execute the warrant. However, the warrant was issued only to the office of the third respondent and it is pending for execution.

4. In view of the above, the third respondent is directed to execute the warrant issued by the District Consumer Disputes Redressal Commission, Chengalpattu in E.A.No.69 of 2024 within a period of 12 weeks from the date of receipt of a copy of this order. The petitioner is also directed to co-operate with the third respondent while executing the warrant.
