The defendants 1 and 2 in C.S.No.331 of 2018 have come up with this application seeking condonation of delay of 69 days in filing the Written Statement.

2. It is the submission of learned counsel for the applicants that the second defendant is a Senior citizen and he was ill, he could not provide the necessary documents to prepare the Written statement and hence, the delay.

3. The learned counsel for the respondents 1 and 2/Plaintiffs opposed this application for condoning the delay stating that the delay was not properly explained by the applicants.

4. However, considering the fact that the delay is only 69 days in filing written statement, this application is allowed.
