ORDER
Challenging the award dated 10.12.2009 passed by the second respondent/Arbitrator, the present Original Petition has been filed. 2.Learned counsel appearing for the petitioner would submit that the award is an exparte one and the learned Arbitrator did not take into consideration the settlement of the disputes even prior to the initiation of the arbitration proceedings.
3.Learned counsel appearing for the first respondent would submit that there are certain other incidental issues involved. However, he submits that the award will never to executed by the first respondent and therefore recording the same, this petition may be closed. Learned counsel appearing for the petitioner is also agreeable for the same.
4.Recording the statement made by the learned counsel appearing for the first respondent that the award will never be executed, this original petition stands closed. No costs. 11.10.2017 mmi
