Crl.O.P.No.16572 of 2023 G.CHANDRASEKHARAN.J., The petitioner namely Raja, who apprehends arrest at the hands of the respondent police for the offence under Section 381 of IPC in Crime No.371 of 2011 subsequently altered into Sections 381, 379 and 109 read with Section 414 of IPC pending on the file of the learned Judicial Magistrate No.I, Poonamallee in C.C.No.23 of 2021, seeks anticipatory bail.

2. The learned counsel for the petitioner submitted that, NBW is pending against the petitioner in C.C.No.23 of 2021 on the file of the learned Judicial Magistrate No.I, Poonamallee. Petitioner surrendered before the Court on 08.05.2023 with a petition to recall of warrant. However, learned Magistrate ordered to remand the petitioner. In the said circumstances, this petition is filed.

3. The learned Government Advocate (Crl. Side) submitted that, petitioner surrendered before the learned Judicial Magistrate No.I, Poonamalle on 08.05.2023. Sensing that, learned Judicial Magistrate 1/3

would remand him, petitioner escaped from the Court. Another case was registered in Crime No. 248 of 2023 for the offence under Section 224 of IPC.

It is seen from the submission of the learned counsel appearing for the parties, petitioner after surrendering before the Court on 08.05.2023, he had run away from the Court without waiting for the orders to be passed by the learned Magistrate. In the said circumstances, this Court is not inclined to grant anticipatory bail to the petitioners.

5. Accordingly, this Criminal Original Petition is dismissed. 28.07.2023 Sma 2/3
